No the entire electromagnetic spectrum for DC to blue light is under the FCC
rules.  That's why flashing a laser pointer at a plane is illegal.  Yes that
would be new homeland security laws too.

Yes, but that's in the radio spectrum. You are (last I checked anyway, 
maybe Homeland Security has banned flashlights) free to transmit light.
